She asserts that a Limited Partnership (LP) formed under the Limited Partnerships Act 1907 does not possess a separate legal personality. It cannot, therefore, sue, be sued, or act as a "legal representative" in a court of law.
"Your statement that this entity has appeared in a number of proceedings is a fabrication," Mrs. Wilkinson writes. "I put you to strict proof of this. Please provide a single example of a Limited Partnership acting as a legal representative on the court record. You will be unable to do so."
This claim directly attacks the credibility of Fairweather Law and their clients' defense. Mrs. Wilkinson contends that the firm is building a strike-out application on a "legal fantasy," an act she describes as a "deliberate attempt to mislead me, as a litigant in person."
A Pattern of Alleged Harassment
Mrs. Wilkinson's letter frames the firm's legal tactics as a continuation of the harassment she and her children have allegedly suffered at the hands of the Bushnells. She dismisses the law firm's "continued and obsessive focus on 'Nathan Paralegals'" as a "transparent and disingenuous attempt to distract from the substantive merits of my claim."
The document also reveals a "drop hands" offer from Fairweather Law, where they proposed dropping the claim if Mrs. Wilkinson agreed to discontinue. This offer, coupled with threats of significant costs, is interpreted by Mrs. Wilkinson as a continuation of the harassment "by proxy."
