FINANCIAL FRAUDSTER NEWS INVESTIGATIONS EXCLUSIVE: Judicial Conspiracy and Cover-Up Alleged at Central London County Court
LONDON – A Financial Fraudster News investigation can exclusively report on an alleged conspiracy between senior judges HHJ Nicholas Parfitt and HHJ Alan Johns, who are accused of a coordinated effort to pervert the course of justice.
The allegations center on an attempt to conceal judicial impropriety connected to HHJ Johns's recent appointment by the Lord Chief Justice.
Evidence suggests the judges acted in concert to unlawfully implicate an innocent man in legal proceedings he knew nothing about, while simultaneously defrauding a legitimate international businessman.
The "Secret Justice" of HHJ Alan Johns
The scandal begins with HHJ Alan Johns, a barrister appointed in the last 12 months, and his handling of a case transferred to the Central London County Court.
Financial Fraudster News can reveal that in his inaugural year, HHJ Johns engaged in what can only be described as "secret justice." In a hearing held without the knowledge of affected parties, HHJ Johns summarily set aside a valid order made by an experienced judge at the Clerkenwell & Shoreditch County Court.
The original Clerkenwell order had reportedly uncovered a significant identity fraud, finding that the claimant in the case was not, as purported, a Russian businessman named Dez Hold. Instead, the judge found the claim was being fraudulently advanced by a convicted murderer, Christian Barabutu (currently at HMP Swaleside), and an associate based in Belfast.
HHJ Johns's intervention allegedly created a "double injustice":
Punishing the Innocent: He issued a General Civil Restraint Order (GCRO) against Mr. Barabutu. This order was made without a hearing and in Mr. Barabutu's absence, allegedly breaching the Human Rights Act 1998 and the Charter of Fundamental Rights.
Defrauding the Victim: He simultaneously struck out the legitimate order that the actual victim, Mr. Dez Hold, had obtained from the Clerkenwell court, ruling it as "without merit."
Mr. Hold, the Russian businessman, had no knowledge of these secret hearings. Mr. Barabutu, speaking to Financial Fraudster News, was baffled: “Why and how is my name caught up in proceedings I know nothing about, and how can I be punished? I have only just found this out and I am making a complaint.”
The Alleged "Cover-Up" by HHJ Nicholas Parfitt
Evidence shown to Financial Fraudster News indicates that in March 2019, Mr. Hold’s legal representatives lodged a High Court application to set aside HHJ Johns's order, citing "fraudulent misrepresentation."
This application was passed to HHJ Nicholas Parfitt, a barrister appointed in 2016. What followed, alleges Mr. Hold, was a "crude" and deliberate cover-up.
Financial Fraudster News has seen details of a hearing listed for 30 August 2019. The parties involved had mutually agreed by consent to an adjournment, as direct access counsel for the defendants was unavailable.
Despite this clear, consensual request, HHJ Parfitt refused the adjournment. In his order, he misrepresented the facts, stating: "no reasons are given and granting the adjournment would fail to utilise the court's time to benefit other litigants."
This statement is a "fraudulent misrepresentation of the truth," according to Mr. Hold.
“Is this the famed British justice?" Mr. Hold stated. "The two judges are clearly working together in a conspiracy. HHJ Johns is caught making fraudulent statements whilst abusing his position... and the other [HHJ Parfitt] crudely lies, saying the parties never gave a reason for an adjournment, when in fact each agreed."
Systemic Erosion of Justice
A legal spokesman who reviewed the evidence described the situation as "extraordinary" and "reckless."
"The level and consistency of highly paid judges are concerning," he commented. "It is simply extraordinary that a judge at the level of HHJ Johns would simply construct an order without due process and based on fraudulent misrepresentations. This is a reckless act and a matter of public interest."
He added that HHJ Parfitt's actions suggest a coordinated effort. "HHJ Parfitt is clearly involved in the earlier decision and has tag-teamed the case... HHJ Parfitt has attempted to cover up the matter by any means possible but has shot himself in the foot... This alleged nepotism brings the civil court system into disrepute, in a climate where even the prime minister is prepared to ignore the law, HHJ Parfitt's actions do not surprise me at all."
This case raises profound concerns about the erosion of legal standards, judicial inexperience, and the misuse of "lofty judicial public positions." The use of secret hearings to produce rulings that escape public scrutiny is a hallmark of an unaccountable system.
