The Met Police Detective Inspector Roth is the officer in charge of a three-year shambolic police investigation of an innocent man arrested on 17th March 2022 after being falsely accused of being a solicitor and barrister struck-off following false allegations by con-man David Richard Smith and ex-airforce serviceman who name faces a jail sentence for perverting the course of justice, perjury and fraud following a private prosecution that has usurped the Met Police investigation led by Detective Inspector Roth.
Smith a serial fraudster and vexatious litigant who used thousands of pounds trying to bring frivolous civil claims in England and Wales in the hope of conning British Airways, Nippon Airlines, Marks and Spencer Plc, Haringey Council and the Metropolitan Police Service into settling large bogus claims found to be without merit when brought before the courts.
Financial Fraudster News can reveal from court papers that even when a series of District Judges dismissed his bogus claims Smith then sued the solicitors and barristers that he instructed by making false representations that he was defrauded of monies he used to pay for services in the first instance.
The investigation led by Detective Inspector Roth of North Area Command has received several IOPC complaints against officers in his team who have been accused of misconduct, unprofessionalism, bias, negligence, discriminatory conduct and racist behaviour in the handling of the three-year old investigation, which has resulted in zero charges.
Unbeknownst to the bungling investigators on 23rd March 2023 the District Judge sitting at Westminster Magistrates’ court issued a Summons for Smith to appear at the court following a private prosecution brought by a victim of Smith’s fraud who recorded Smith falsely stating that an employee of the company introduced himself as a solicitor and barrister who he states is now struck-off when he first met Smith.
Smith faces a prison sentence if convicted of the allegations that include fraud, perverting the course of justice and perjury.
Smith is accused of knowingly filing a false report to the Met Police that the victim introduced himself as a solicitor and barrister when the victim’s company emails confirmed he had read media reports clearly identifying the victim’s professional status and clearly stating that he was not a barrister or a solicitor.
The bungled Met Police investigation that has dragged on for over three-years started with Smith’s bogus complaint which convinced trainee Met Detectives, led by Detective Inspector Roth that he had been a victim of fraud, the facts are that Smith defrauded Halifax Bank and when Halifax Bank demanded evidence of the fraud, Smith motivated by greed hatched his fraud scheme during the COVID-19 period which included falsely stating the victim had impersonated a solicitor and a barrister in order to obtain legal fees.
Smith will appear first at Westminster Magistrates’ Court April 2023 before the matter is sent to the Crown Court.
The hapless Met Police investigation that has now been usurped by private investigators who identified and gathered evidence of Smith’s criminal conduct that has caused the wrongful arrest and imprisonment of the victim.
Financial Fraudster News can reveal that the most recent report by His Majesty’s Inspectorate of Constabulary and Fire Rescue Services (HMICFRS), which details how the Met fail to record 69,100 crimes in a year was a major factor in a decision to place the Force into special measures.
Financial Fraudster News can reveal that the investigation led by Detective Inspector Roth deliberately failed to record the victim’s complaint against Smith made in 2021 on the grounds that he was not afford the same level of police response which the victim found to be discriminatory and racist, and which resulted in material breaches of the PACE Act 1984.
The pressure is on for answers how an experienced officer such a Detective Inspector Roth has led such an ineffective investigation that failed to act fairly, impartially and non-discriminatory to the extent a private prosecution has been brought against Smith who as an ex-serviceman has swayed a professional team of detectives over a three-year period that has from the outset invited a series of patterns of unprofessional behaviour, a litany of breaches of the PACE Act, failure to investigate the true victim’s complaint followed by a failure to see the signs of Smith’s criminal behaviour and motives.
Officers connected to the three-year investigation face IOPC investigations, and the Met's own professional standards scrutiny regarding several complaints during the Met's failed investigation that amounted to the victim’s false arrested and imprisonment.
Sources close to the private prosecution believe that several Met Officers will be called as witnesses if the matter goes to trial; but it is believed based on the overwhelming evidence of criminality of which Smith must now appear as a defendant.
