Alleged Crown Prosecution Service Misconduct and Failures of Oversight in Woolgrove Road Case

Hitchin, Hertfordshire, UK – A SPOKESPERSON FOR CHERYL PLUMMER (INTERNATIONAL) LLC has released details of serious concerns regarding the handling of matters relating to the property at 54, Woolgrove Road, Hitchin, Hertfordshire, raising questions about potential misconduct and failures of oversight by the Crown Prosecution Service (CPS) and investigating authorities.

The case involves a criminal trespasser, Stephen Flattery, residing at the property.

County Court Proceedings

Information from a Cheryl Plummer LP file reveals that on 28 May 2021, Stephen Flattery attended a possession hearing at Luton County Court sitting at Stevenage Magistrates’ Court. A litigation assistant from Nathan Alfonzo and Partners (UK), Leslie Gayle-Childs, was present on behalf of Tuscany Trust Holding Trustees LP, who had conducted an identification investigation to establish the occupant of the property. Gayle-Childs was there to support Counsel instructed by Tuscany Trust Holding Trustees LP trustee, the former owner of the property.

At the preliminary hearing, District Judge Waring, in the absence of counsel, granted rights of audience to the Nathan Alfonzo and Partners litigation assistant attendee under Civil Procedure Rule 39.6 and subsequently adjourned the hearing.

Details from the hearing identified a close relationship between Stephen Flattery and DC David Quinn.

Further investigations have revealed that Stephen Flattery claimed he was “Bullet Proof” and able to sell the property without proper documentation. These statements were made during an undercover private investigation conducted on behalf of Tuscany Trust Holding Trustees LP, involving Stephen Flattery and John Dolan, alleged members of an organised crime group associated with the property.

During the court hearing, Stephen Flattery is alleged to have perverted the course of public justice by falsely claiming that John Dolan was the landlord, and that he had spent substantial sums on renovations and legal fees. This is contradicted by his later statement to a High Court financial examiner that he had no money or assets at the time.

Assured Shorthold Tenancy Agreement

Investigators uncovered evidence of a conspiracy to forge an Assured Shorthold Tenancy (AST) agreement, dated 14 January 2019, and signed by John Dolan, Flattery, and Odette Trimble. Trimble is alleged to be Flattery’s mother. This is nearly a year before Flattery stated in a witness statement dated 13 October 2022, that “About 12 February 2020 I went to the address and met a man called John Doland who told me that he owned the property.”

The AST agreement is described as a poor-quality document with spelling errors and missing pages, setting the term at 3 years and 1 day. While there is no maximum length for an AST, tenancy agreements exceeding three years must legally be in the form of a "Deed."

The fraudulent document was allegedly ignored by DC David Quinn, CPS lawyer Andrew Sarkany, and Crown prosecutor James Norman, in what is described as obstruction of justice and potential conspiracy.

The Crown Prosecution Service (CPS)

The CPS lawyer Andrew Sarkany is alleged to be fully aware that evidence being relied upon in a criminal prosecution originates from Stephen Flattery, who stole the contents of a mail package sent to 54, Woolgrove Road, Hitchin, Hertfordshire.

The stolen contents relate to a civil action between Whiting Timmis and Partners LP and Cheryl Plummer LP. Whiting Timmis and Partners LP is a subsidiary of Cheryl Plummer LP, the owner of 54, Woolgrove Road, Hitchin.

The Barrister

It is alleged that Andrew Sarkany, contrary to section 22 of the Theft Act 1968, authorised prosecutor James Norman to use stolen mail from Stephen Flattery, violating section 84(3) of the Postal Services Act 2000. The mail was taken during a "sting operation" by Flattery's employer to expose his involvement with investigating authorities.

A spokesperson for Cheryl Plummer (International) LLC stated that the extent of the failure of oversight by both prosecuting and authorities has caused alarm, particularly regarding the failure to remove the criminal trespasser, who boasted that he was "bullet proof" from arrest if he chose to sell the property. This was disclosed in a private prosecution brought against Flattery by Cheryl Plummer (International) LLC.

Malicious Prosecution

Cheryl Plummer (International) LLC argues that the prosecution’s focus on an innocent suspect, contracted to assist in the removal of Stephen Flattery, has been disproportionate, leading to the suspect's arrest.

Investigating authorities are accused of falsely stating that the innocent suspect appeared at a preliminary repossession hearing at Luton County Court sitting at Stevenage Magistrates’ Court on 28 May 2021 before District Judge Waring. It is alleged that undercover policeman Detective Constable David Quinn falsely stated to the innocent suspect’s probation officer, Jane Carpentieri, with the intent to have him recalled to prison that “your client told the court that Edward Whiting had taken out a loan in 2002 with a company called Whiting Timmis and Partners LP which had been secured against the property. He stated that Mr Whiting had subsequently defaulted on the loan and that the loan agreement was thought to have been lost but had since been recovered. Mr Alphonso stated that on the 15th of July 2020 District Judge Bever are sitting in the county courts of England and Wales had ordered that the property be transferred to Whiting Timmis and Partners LP who will now trade as TTHT”. The innocent suspect was subsequently recalled by Jane Carpentieri.

Cheryl Plummer (International) LLC believes that the CPS’s prosecutorial overreach is an attempt to circumvent extant High Court civil proceedings involving similar facts, which have found Stephen Flattery liable for lost rental income and granted a writ of possession for his removal from 54, Woolgrove Road, Hitchin.

Cheryl Plummer (International) LLC is pursuing all available legal avenues to address these concerns and ensure that justice is served.
